We explain further rights in connection with data protection using the specific examples below in the text.

Storage of access data in server log files

You can visit our websites without providing any personal information. We only store access data in so-called server log files, such as the name of the requested file, the date and time of the request, the amount of data transferred and the requesting provider. This data is evaluated exclusively to ensure trouble-free operation of the site and to improve our offer and does not allow us to draw any conclusions about your person.

General information
Although you also have the possibility to view and buy our assortment in selected stores in person, Defshop is a web-based street fashion provider. This means that we are particularly dependent on finding out about the interests and preferences, the likes and dislikes, the wishes and shopping ideas of our customers online, i.e. by collecting corresponding data. What you would say to one of our sales assistants during a personal visit to a store, we can only learn online by collecting data. So when we talk about "legitimate interests" in terms of data protection regulations, we mean (among other things) this particular type of business relationship and interaction between you and us.

Data transfer abroad
Some of the partners with whom we - and therefore you - exchange data are located outside the European Union. There have been various agreements between the EU and other countries regarding the data protection of their respective guarantors, first the so-called "Safe Haven" and then the so-called "Privacy Shield" agreement. Both agreements have been found illegal by the European Court of Justice (most recently ECJ judgment of July 16, 2020 (C-311/18) "Schrems II"). Thus, a data transfer to third countries in which a level of data protection that is not comparable to the standard in the EU does not exist and in which it is not ensured that you can exercise your data protection rights effectively and efficiently, is in principle inadmissible. By agreeing to our cookie policy and our privacy policy, you allow us to transfer data to - now so-called - insecure third countries (e.g. to Facebook and Google).

SEMKNOX Search
Our website uses a service of SEMKNOX GmbH, Webergasse 1, 01067 Dresden, Germany, for internal product search. With this service you will be shown the matching products to your search query via our website. For this purpose, your search query is transmitted directly to SEMKNOX. This also includes the transmission of your IP address and, if applicable, an assigned session ID. Both pieces of information can have a personal reference. A transmission of further personal data does not take place.
For this purpose, SEMKNOX uses so-called "cookies", i.e. text files which are stored on your computer and which enable the successful execution of the search function by you. The information generated by the cookie about your use of the search function will be transmitted to and stored by SEMKNOX on servers in Germany. On our behalf, SEMKNOX will use this information to respond to your search request.
The cookie contains the last QueryId assigned by the SEMKNOX search service and is stored for 24h.
The processing of the information generated by the cookie and transmitted to SEMKNOX is based on Art. 6 para. 1 lit. f) EU-DSGVO for the purpose of tailoring our website to your needs.

After complete processing of the contract or deletion of your customer account, your data will be blocked for further use and deleted after expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you below. The deletion of your customer account is possible at any time and can be done either by sending a message to the contact option described below or via a function provided for this purpose in the customer account.

For the processing of payments, we pass on the payment data required for this to the credit institution commissioned with the payment and, if applicable, to payment service providers commissioned by us or to the payment service selected by you in the ordering process.

Unsubscribing from the newsletter is possible at any time and can be done either by sending a message to the contact option described below or via a link provided for this purpose in the newsletter.

Use of cookies
In order to make visiting our website more attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your terminal device. Some of the cookies we use are deleted at the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your end device and allow us to recognize your browser the next time you visit (persistent cookies). You can set your browser so that you are informed about the setting of cookies and decide individually about their acceptance or exclude the acceptance of cookies for certain cases or in general. If you do not accept cookies, the functionality of our website may be limited.
Our checkout solution is provided by Klarna (Klarna AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden) and uses cookies to provide you with an ideal, customized online experience when using Klarna's checkout. A detailed list of cookies and an explanation of their respective purpose can be found here for Germany and here for Austria.
Furthermore, cookies from Google Inc. are also stored, which collect and store information about the surfing behavior of website visitors for marketing purposes in anonymized form. This enables targeted product recommendations to be displayed in the form of advertising banners or advertisements on third-party websites (so-called publishers). This data cannot be used to personally identify visitors to the website. The collected data will only be used for demand-oriented design or improvement of the offer. It will not be used in any other way or passed on to third parties. You can find all important information about Google cookies here. If you do not wish to accept the cookies of our service providers and partners, you can select the setting in your browser "Block third-party cookies". As a rule, you will be shown in the menu bar of your web browser via the help function how to reject new cookies and disable those you have already received. Detailed information on how to make the settings in the browser you use can be found at the following link. We recommend that if you use shared computers that are set to accept cookies and Flash cookies, you always log out completely when you are finished.
We use the tracking technology of Linkster GmbH, Geschwister-Scholl-Straße 52, 20251 Hamburg, Germany, on this site to measure and visualize insights into partnerships and advertising channels. This is a function to measure the efficiency of the corresponding advertising measures. Furthermore, the information enables us to assign advertising successes for billing purposes with corresponding advertising partners. When you click on an advertising integration, cookies are set in your browser, which are read in the event of a transaction. At each touch point, your browser sends an HTTP request to Linkster's server, with which certain information is transmitted. This information includes the URL of the website on which advertising material is placed (referrer URL), the browser identifier (user agent) of your end device (including information about the device type and operating system), the IP address of the end device (this IP address is anonymized and hashed by us before storage), HTTP headers (data package automatically transmitted by your browser with various technical information), the time of the request and, if already stored on the end device before, the cookie with its content. A cookie is a small data packet that is exchanged between your browser and the server. Information relevant to the web application can be stored and transmitted in this data packet, e.g. the contents of a virtual shopping cart. The tracking technology stores cookies on your terminal device to document actions. A 24-digit, anonymous ID is stored in the cookie. Linked to this ID, the data is stored in encrypted form in our database on the server. This contains information about the last touch points (i.e. when a particular advertising medium was displayed or clicked on by an end device). If necessary, the stored touch points can be combined to form a sequence chain (user journey). In the case of a promotion request, the order number and the shopping cart value of your order are usually also transmitted and stored by us. In addition, the following values may be transmitted and stored: Your customer number, new customer characteristic, your age and gender as well as the information provided by you in a customer survey. The cookies stored by Linkster GmbH are deleted after 30 days at the latest. The information transmitted to us and the cookies serve the sole purpose of a correct allocation of the success of an advertising medium and the corresponding billing and is justified with our legitimate interests according to Art. 6 para. 1 p. 1 lit. f DSGVO. If you do not wish cookies to be stored in your browser, you can do this by making the appropriate browser settings. You can deactivate the storage of cookies in your respective browser under Extras/Internet options, limit it to certain websites or set your browser to notify you as soon as a cookie is sent. Please note, however, that in this case you must expect a restricted display of the online offers and a restricted user guidance. You can also delete cookies at any time. In this case, the information stored in them will be removed from your end device. The collection and processing of tracking data can also be deactivated by clicking on this tracking opt-out link: https://trck.linkster.co/privacy-optout.do.
Viewing your data: https://trck.linkster.co/privacy-mydata.do
You can see which cookies are used in detail by our tracking technology in the following overview:
TRS: Unique, 24-digit identifier (ID) for tracking partnerships. This cookie is stored in the client browser and identifies database records that contain touchpoint data.
TRSCJ: Fallback cookie containing the rudimentary touchpoint data for tracking partnerships. This cookie contains encrypted all touchpoint data at the client browser. trs_db_optout: When the tracking opt-out link is clicked, a special cookie is written, disabling tracking in the current endpoint web browser. However, tracking will be enabled again once you delete tracking opt-out cookie.
